14/04/0002 Erection of dwelling and garage on land to the East of 12 Manor Road - Outline application. I was agreed that being within the curtilage of a listed building any new development would need to be totally sympathetic in both design and materials. A cottage style house with low aspect would seem appropriate to act as a gradient between the buildings on the two sides. It was felt that the barn at the end of the site should be protected. There were serious concerns regarding access and egress, the road being extremely narrow at this point. Villagers and Council were dismayed that the mature Walnut tree had been removed and wondered if it would be necessary to get TPOs put on all mature trees in an effort to prevent further losses. The VDS currently being written refers to the open aspect which is likely to be further eroded with the loss of yet another large garden used for development.

CONDITIONS AND REASONS
1 Approval of the details of the siting, design and external appearance of the building[s], the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the local planning authority in writing before any development is commenced. Plans and particulars of the reserved matters referred to above, relating to the siting, design and external appearance of any buildings to be erected, the means of access to the site and the landscaping of the site, shall be submitted in writing to the local planning authority and shall be carried out as approved. Application for approval of the reserved matters shall be made to the local planning authority before the expiration of three years from the date of this permission. The development hereby permitted shall be begun either before the expiration of five years from the date of this permission, or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later. Reasons: The application was submitted as an outline application in accordance with the provisions of Article 3(1) of the Town and Country Planning (General Development Procedure) Order 1995. In accordance with the provisions of Section 92 of the Town and Country Planning Act, 1990.


2 The development hereby permitted shall not be commenced until particulars of the materials (including the provision of samples where appropriate) to be used for external walls and roofs have been submitted to and approved in writing by the local planning authority. Reason -- In the interests of visual amenity and to safeguard the setting of the adjacent listed building in accordance with policy H3 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000 and policy 9 of the Somerset & Exmoor National Park Joint Structure Plan, April 2000.


3 Before the development hereby permitted is commenced details of the material and external finish to be used for all windows and doors shall be approved in writing by the local planning authority. Such approved details, once carried out shall not be altered without the prior written consent of the District Planning Authority. Reason -- In the interests of visual amenity at to safeguard the setting of the adjacent listed building in accordance with policy H3 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000 and policy 9 of the Somerset & Exmoor National Park Joint Structure Plan, April 2000.


4 No development shall take place until the applicant, or their agents or successors in title, has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted to and approved in writing by the local planning authority. Reason -- To safeguard the archaeological potential of the site in accordance with policy HE9 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.


5 Before the development hereby permitted is commenced details of the boundary treatment shall be submitted to and approved in writing by the District Planning Authority. Once approved such details shall be fully implemented before the dwelling is first occupied. Reason -- In the interests of visual and residential amenity in accordance with policy H3 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.


6 The development hereby permitted shall not be commenced until there has been submitted to and approved in writing by the local planning authority a scheme of landscaping, which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of the development, as well as details of any changes proposed in existing ground level. All planting, seeding, turfing or earth moulding comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the building or the completion of the development, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with other of similar size and species unless the local planning authority given written consent to any variation. Reason -- In the interests of visual amenity in accordance with policy H3 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.


7 There shall be no obstruction to visibility greater than 900mm above adjoining carriageway level, forward of a line drawn 2.0m back and parallel to the carriageway over the entire site frontage, including land edged blue on the submitted plan. Such visibility shall be fully provided before works commence on the dwelling hereby permitted, and shall thereafter be maintained at all times. Reason -- In the interests of highways safety in accordance with policy TM1 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.


8 A recessed access 3.0m wide shall be constructed 4.5m back from the carriageway edge and its sides shall be splayed at an angle of 45 degrees towards the carriageway edge. The area between the entrance and the edge of the carriageway shall be properly consolidated and surfaced (not loose stone or gravel) in accordance with details which shall have been submitted to and approved by the Local Planning Authority. Reason -- In the interests of highways safety in accordance with policy TM1 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.


9 Any entrance gates shall be hung to open inwards and set back a minimum distance of 4.5m from the carriageway edge. Reason -- In the interests of highways safety in accordance with policy TM1 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.


10 Plans showing a parking area for two vehicles shall be submitted to and approved by the Local Planning Authority before development is commenced. This area shall be properly consolidated before the dwelling hereby permitted is first occupied, and shall not be used other than for the parking of vehicles in connection with the development hereby permitted. Reason -- In the interests of highways safety in accordance with policy TM1 of the Sedgemoor District Local Plan (Revised Deposit Draft), October 2000.
